1. Acceptance of These Terms

Welcome to Ciphertainment.

These Terms of Use (“Terms,” “Agreement,” or “Terms of Use”) govern your access to and use of Ciphertainment, GenX Defenders, and related websites, applications, games, content, features, and services provided by Technirise Consulting Inc.

Please read these Terms carefully before using the Services.

By accessing or using Ciphertainment or GenX Defenders, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Services.

If you are under the age of majority in your jurisdiction, your parent or legal guardian may need to review and agree to these Terms on your behalf.

Our corporate and product structure

For clarity:

• Technirise Consulting Inc. (“Technirise”) is the legal entity that owns and operates the Services.
• Ciphertainment is a gaming and educational technology platform operated by Technirise.
• GenX Defenders is a cybersecurity educational game made available through Ciphertainment.
• “Services” means Ciphertainment, GenX Defenders, associated websites, applications, games, content, features, and related services provided by Technirise.

These Terms form an agreement between you and Technirise Consulting Inc.

2. Eligibility and Age Requirements

GenX Defenders is designed primarily for users between 10 and 16 years of age, although adults may also use the Game.

You may use the Services only if:

• you meet the applicable age requirements;
• you are legally permitted to enter into these Terms; or
• where required, your parent or legal guardian has reviewed and accepted these Terms on your behalf.

If you are under the age of majority where you live, you should use the Services with the knowledge and involvement of your parent or legal guardian.

Parents and legal guardians are responsible for supervising a minor's use of the Services as appropriate for the child's age and circumstances.

Nothing in these Terms limits any rights or protections that children or consumers may have under applicable law.

3. Parents and Legal Guardians

If you are a parent or legal guardian permitting a child to use GenX Defenders, you agree that:

• you have reviewed these Terms and our Privacy Policy;
• you are responsible for determining whether the Services are appropriate for the child;
• you will provide appropriate supervision based on the child's age and circumstances;
• you will help the child understand these Terms and appropriate online behavior;
• you will take reasonable steps to prevent the child from sharing sensitive personal information through the Services;
• you will notify us if you believe the child's account has been compromised or misused; and
• where applicable, you consent to the child's use of the Services and the handling of information as described in our Privacy Policy.

Where applicable law requires verifiable parental consent for the collection, use, or disclosure of a child's personal information, Technirise will follow the applicable legal requirements.

Our Privacy Policy provides additional information about children's privacy and parental rights.

4. The Services

Ciphertainment provides interactive gaming and educational experiences.

GenX Defenders is an educational cybersecurity action-adventure game designed to introduce players to cybersecurity concepts through gameplay.

The Services may include:

• interactive games;
• cybersecurity challenges;
• educational content;
• missions;
• virtual organizations;
• characters;
• game environments;
• achievements;
• scores;
• educational resources;
• game updates;
• technical support; and
• other functionality introduced by Technirise.

We may add, modify, suspend, or remove features from the Services from time to time.

Certain features may require an account, parental involvement, payment, or other conditions.

5. Educational Purpose

GenX Defenders is designed as an educational game.

The cybersecurity concepts presented in the Game are intended to provide general educational information and practical learning experiences.

The Game is not intended to:

• provide professional cybersecurity certification;
• replace formal cybersecurity education;
• provide professional security advice;
• authorize users to test systems they do not own or have permission to test;
• provide authorization to access computer systems or networks; or
• encourage unlawful access to computer systems.

Players must use cybersecurity concepts learned through the Game responsibly and only in environments where they have appropriate authorization.

6. Accounts

Certain Services may require an account.

When creating an account, you agree to provide accurate information where information is required.

You must not:

• create an account using another person's identity without permission;
• impersonate another person;
• create an account for someone without appropriate authorization;
• provide false information to circumvent age or parental requirements;
• share your password with another person; or
• use another person's account without authorization.

You are responsible for taking reasonable steps to protect account credentials.

If you believe an account has been compromised, you should notify Technirise promptly.

Technirise may suspend or restrict an account where we reasonably believe that the account has been compromised, misused, or used in violation of these Terms.

7. Child Accounts

Where GenX Defenders provides accounts for children, the account may be subject to additional safeguards.

Depending on the applicable jurisdiction and Service configuration, these safeguards may include:

• parental consent;
• age verification or age declaration;
• parental controls;
• restrictions on communications;
• limitations on data collection;
• restrictions on external links;
• restrictions on purchases; and
• other age-appropriate controls.

The availability of specific features may differ based on age, jurisdiction, platform, and applicable legal requirements.

8. Acceptable Use

You agree to use the Services responsibly, lawfully, and in accordance with these Terms.

You must not use the Services to:

• violate any applicable law or regulation;
• harm another person;
• threaten, intimidate, bully, or harass another person;
• impersonate another person or organization;
• obtain another person's password or private information;
• distribute malware;
• distribute ransomware;
• conduct phishing attacks;
• conduct unauthorized penetration testing;
• gain unauthorized access to systems or networks;
• disrupt or damage computer systems;
• attack or interfere with Ciphertainment infrastructure;
• bypass security controls;
• circumvent access restrictions;
• interfere with the operation of the Services;
• upload malicious code;
• exploit vulnerabilities in the Services;
• collect information about other users without authorization;
• engage in fraud or deception;
• use the Services to facilitate criminal activity; or
• encourage another person to engage in unlawful or harmful activity.

Cybersecurity concepts presented in GenX Defenders are intended for authorized, ethical, and educational use only.

9. Prohibited Content and Conduct

You must not upload, transmit, publish, or otherwise make available through the Services content that:

• is unlawful;
• is threatening;
• is abusive;
• is defamatory;
• is discriminatory;
• promotes hatred or violence;
• contains sexual exploitation or child sexual abuse material;
• is pornographic or sexually explicit;
• contains excessive or gratuitous graphic violence;
• promotes self-harm;
• promotes criminal activity;
• contains malware or malicious code;
• infringes intellectual property rights;
• violates another person's privacy;
• contains another person's confidential information without authorization; or
• is otherwise inappropriate for the intended audience of the Service.

Because GenX Defenders is designed for younger users, Technirise may apply stricter content and conduct standards than would otherwise apply to a general-audience gaming platform.

10. Child Safety

Technirise has zero tolerance for conduct involving the exploitation, sexualization, grooming, harassment, or abuse of children.

Users must not use the Services to:

• groom or solicit a child;
• request sexual content from a child;
• share sexual content with a child;
• request personal information from a child for inappropriate purposes;
• arrange an inappropriate meeting with a child;
• threaten or blackmail a child;
• encourage a child to move communications to an unsafe external platform; or
• otherwise engage in conduct that places a child at risk.

We may suspend or terminate accounts and may report suspected illegal activity to appropriate authorities where required or permitted by law.

11. Cybersecurity and Ethical Use

GenX Defenders may simulate cybersecurity activities, including security incidents, vulnerabilities, attacks, investigations, and defensive activities.

These simulations are provided for educational purposes.

You agree not to use knowledge, techniques, tools, or information obtained through the Services to:

• access a computer, network, account, application, or system without authorization;
• steal information;
• disrupt services;
• deploy malware;
• evade security controls;
• compromise another person's account;
• conduct denial-of-service attacks;
• conduct unauthorized vulnerability testing; or
• engage in any other unlawful cybersecurity activity.

You are responsible for ensuring that any cybersecurity testing you conduct outside the Game is properly authorized.

12. Intellectual Property

The Services and their contents are owned by Technirise or its licensors and are protected by applicable intellectual property laws.

This includes, without limitation:

• Ciphertainment;
• GenX Defenders;
• names;
• logos;
• trademarks;
• characters;
• artwork;
• graphics;
• game environments;
• animations;
• audio;
• music;
• videos;
• software;
• source code;
• object code;
• game mechanics and implementations;
• text;
• educational content;
• cybersecurity scenarios;
• documentation;
• interfaces;
• designs; and
• other materials made available through the Services.

Except as expressly permitted by these Terms, you do not receive ownership of any intellectual property by using the Services.

13. Limited License

Subject to these Terms, Technirise grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for their intended purpose.

For individual users, this license is primarily for personal and non-commercial use unless Technirise expressly authorizes another use.

You may not:

• copy the Services;
• reproduce the Game;
• sell access to the Game;
• rent or lease the Services;
• sublicense the Services;
• redistribute the Game;
• modify the Game;
• create derivative works;
• reverse engineer the software;
• decompile or disassemble the software;
• extract source code;
• circumvent technical protections;
• remove copyright or trademark notices; or
• use the Services to create a competing product.

Nothing in these Terms transfers ownership of Technirise's intellectual property to you.

14. Trademarks

“Technirise,” “Ciphertainment,” “GenX Defenders,” and associated logos, names, and marks may be trademarks or trade names of Technirise or its licensors.

You may not use our trademarks without prior written permission.

You may not use our trademarks in a manner that suggests that Technirise endorses, sponsors, or is affiliated with a product, service, organization, or individual without our written authorization.

15. User Content

Some versions of Ciphertainment may allow users to submit content.

“User Content” means content submitted, uploaded, transmitted, or otherwise made available by a user through the Services.

If User Content functionality is enabled, you remain responsible for the content you submit.

You must not submit content that:

• violates these Terms;
• violates another person's rights;
• contains confidential information;
• contains unnecessary personal information about a child;
• infringes intellectual property rights;
• contains malicious code; or
• is unlawful or harmful.

16. License to User Content

If you submit User Content to the Services, you grant Technirise a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and use that content solely as reasonably necessary to operate, maintain, secure, support, and improve the applicable Service.

We will handle personal information contained in User Content in accordance with our Privacy Policy.

We do not obtain ownership of your User Content merely because you submit it.

Technirise may remove User Content that violates these Terms or that we reasonably believe creates legal, security, safety, or operational risks.

17. Feedback

If you provide suggestions, ideas, comments, recommendations, or other feedback concerning Ciphertainment or GenX Defenders, you agree that Technirise may use that feedback without compensation or attribution to you.

This provision does not give Technirise ownership of your independently created intellectual property; it permits us to use feedback to improve our Services.

18. Third-Party Services

The Services may contain or depend on third-party services, software, platforms, payment providers, hosting providers, or other technologies.

Third-party services may have their own terms and privacy policies.

Technirise is not responsible for third-party services that it does not control.

Where third-party services process personal information on our behalf, their handling of information will also be subject to our Privacy Policy and applicable contractual requirements.

19. App Store Terms

If you download GenX Defenders through Apple's App Store, your use of the Game is also subject to Apple's applicable terms and policies.

Apple is not responsible for providing maintenance or support services for GenX Defenders unless required by applicable law.

Apple is not responsible for addressing claims relating to the Game except to the extent required by applicable law.

Your use of GenX Defenders must also comply with Apple's applicable terms and policies.

Apple's App Store Review Guidelines require apps to comply with applicable laws and impose specific privacy and child-safety requirements.

20. Purchases and Paid Services

Some Ciphertainment or GenX Defenders features may be offered for free, while other features may require payment.

Where payment is required, we will provide information about the applicable price and purchase terms before the transaction.

If a purchase is processed through Apple or another app store, the transaction may be governed by that provider's payment and subscription terms.

Technirise does not intentionally collect or store a child's complete payment card information through GenX Defenders.

Where purchases are available to younger users, appropriate platform controls, parental controls, parental gates, and applicable legal requirements may apply.

21. Subscriptions

If Technirise offers subscriptions:

• the applicable price and billing period will be disclosed before purchase;
• renewal terms will be disclosed before purchase;
• cancellation procedures will be provided;
• subscription billing may be handled by the applicable app store or payment provider; and
• refunds may be subject to the applicable platform's policies and applicable consumer protection law.

Nothing in these Terms limits mandatory consumer rights relating to cancellation, refunds, or subscriptions.

22. Availability of the Services

We strive to keep Ciphertainment and GenX Defenders available and reliable.

However, we do not guarantee that the Services will:

• always be available;
• be uninterrupted;
• be error-free;
• operate on every device;
• remain compatible with every operating system version; or
• always contain the same features.

The Services may occasionally be unavailable because of:

• maintenance;
• updates;
• technical problems;
• security incidents;
• third-party service failures;
• network problems;
• platform changes; or
• circumstances beyond our reasonable control.

23. Changes to the Services

Technirise may modify, update, suspend, or discontinue all or part of the Services.

We may:

• add new features;
• remove features;
• modify gameplay;
• change educational content;
• update technical requirements;
• modify account functionality;
• change pricing; or
• discontinue a Service.

Where applicable law requires notice of material changes, we will provide the required notice.

24. Updates

You may be required to install updates to continue using GenX Defenders.

Updates may include:

• security patches;
• bug fixes;
• performance improvements;
• new content;
• compatibility changes; and
• feature changes.

Failure to install required updates may affect the functionality or security of the Game.

25. Privacy

Your privacy is important to us.

Our collection, use, disclosure, retention, and protection of personal information are described in the Ciphertainment and GenX Defenders Privacy Policy.

The Privacy Policy forms part of the overall framework governing your use of the Services.

26. Security

You must not attempt to compromise or interfere with the security of Ciphertainment or GenX Defenders.

Prohibited activities include:

• vulnerability exploitation;
• unauthorized penetration testing;
• credential attacks;
• denial-of-service attacks;
• malware deployment;
• unauthorized access;
• bypassing authentication;
• bypassing technical controls;
• reverse engineering security mechanisms for unauthorized purposes; and
• attempting to access restricted infrastructure.

If you discover a security vulnerability in the Services, please report it responsibly to Technirise using our designated security contact.

27. Reporting Abuse, Safety Issues, or Violations

If you become aware of:

• harassment;
• bullying;
• inappropriate content;
• child-safety concerns;
• account abuse;
• security vulnerabilities;
• unauthorized access;
• malicious activity; or
• violations of these Terms,

Where appropriate, we may investigate reports and take action, including content removal, account restrictions, suspension, or termination.

28. Account Suspension and Termination

Technirise may suspend or terminate your access to the Services if we reasonably believe that you:

• violated these Terms;
• violated applicable law;
• compromised the security of the Services;
• engaged in abusive or harmful conduct;
• created a risk to another user;
• provided false information to circumvent safeguards;
• misused an account; or
• otherwise used the Services in a manner inconsistent with their intended purpose.

Where appropriate and permitted by law, we may provide notice before termination.

However, we may suspend or terminate access immediately where necessary to:

• protect children;
• protect users;
• protect the security of the Services;
• prevent fraud;
• address serious misconduct; or
• comply with legal obligations.

29. Effect of Termination

Upon termination:

• your right to access the applicable Services may end;
• your account may be disabled;
• certain game progress may become unavailable; and
• licenses granted under these Terms may terminate.

Termination does not affect rights or obligations that by their nature should survive termination.

Sections concerning intellectual property, disclaimers, limitations of liability, dispute resolution, and other provisions intended to survive termination will continue to apply.

30. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an “as available” and “as is” basis.

Technirise does not guarantee that:

• the Services will always be available;
• the Services will be error-free;
• information provided through the Services will always be complete or current;
• the Game will meet every user's expectations; or
• defects will always be corrected.

The cybersecurity information provided through GenX Defenders is educational in nature and should not be treated as professional cybersecurity advice.

Nothing in these Terms excludes any warranty, guarantee, or consumer protection right that cannot lawfully be excluded.

31. Limitation of Liability

To the maximum extent permitted by applicable law, Technirise and its directors, officers, employees, contractors, licensors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.

This may include, where legally permitted:

• loss of data;
• loss of game progress;
• loss of profits;
• business interruption;
• loss of goodwill; or
• other indirect losses.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including liability that cannot legally be excluded or limited.

For consumers, these limitations apply only to the extent permitted by applicable consumer protection law.

32. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Technirise and its directors, officers, employees, contractors, licensors, and service providers from claims, damages, liabilities, losses, and reasonable expenses arising from:

• your violation of these Terms;
• your unlawful use of the Services;
• your infringement of another person's rights;
• User Content you submit; or
• your misuse of the Services.

This section does not apply to the extent that the claim results from Technirise's own unlawful conduct or negligence where such exclusion is prohibited by law.

For minors, this provision applies only to the extent permitted by applicable law.

33. Children's Rights and Consumer Protection

Nothing in these Terms is intended to remove or limit rights that cannot legally be waived.

Children and consumers may have rights under applicable privacy, consumer protection, education, and other laws.

If any provision of these Terms conflicts with a mandatory legal right, the mandatory legal requirement will prevail to the extent of the conflict.

34. Changes to These Terms

Technirise may update these Terms from time to time.

Changes may be made because of:

• changes to the Services;
• new features;
• changes in technology;
• changes in law;
• changes to our business;
• security requirements; or
• other legitimate operational reasons.

When we make material changes, we will take reasonable steps to notify users.

The updated Terms will include a new “Last Updated” date.

Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Where consent is legally required for a material change, we will obtain the required consent.

35. Governing Law

These Terms will be interpreted in accordance with the laws applicable to Technirise and the applicable user, subject to mandatory consumer protection and other laws that cannot be excluded.

Nothing in these Terms prevents a consumer from exercising rights available under mandatory laws in their jurisdiction.

Where a specific jurisdiction is designated for a particular Service, that designation will be disclosed in the applicable terms.

36. Dispute Resolution

We encourage users and parents or guardians to contact us first to resolve concerns.

If you have a complaint or dispute concerning the Services, please contact:

Nothing in this section prevents an individual from exercising rights available under applicable consumer protection, privacy, or other mandatory laws.

37. Force Majeure

Technirise will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including:

• natural disasters;
• war;
• terrorism;
• government actions;
• widespread internet failures;
• telecommunications failures;
• power failures;
• cyberattacks;
• third-party service failures;
• labor disruptions; or
• other events beyond our reasonable control.

38. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be modified or removed only to the extent necessary.

The remaining provisions will continue in effect.

39. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into the Services, constitute the agreement governing your use of Ciphertainment and GenX Defenders.

If there is a conflict between these Terms and a specific additional term applicable to a particular Service, the specific additional term will apply to the extent of the conflict.

40. No Waiver

If Technirise does not immediately enforce a provision of these Terms, that does not mean that Technirise has waived its right to enforce that provision later.

41. Assignment

You may not assign or transfer your rights or obligations under these Terms without Technirise's prior written consent.

Technirise may assign these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, or similar transaction, subject to applicable law.

If you are a parent or legal guardian permitting a minor to use the Services, you acknowledge that you have reviewed these Terms and understand the provisions applicable to the minor's use of the Services.
